Terms of Use

The MyEmergencyCrew Web Site ("Web Site") is owned and operated by Gerard Dunning ABN 44 307 959 263 (trading as MyEmergencyCrew).

By accessing the Web Site you acknowledge your acceptance of the terms, conditions, notices and disclaimers contained on the Web Site ("Terms").

MyEmergencyCrew reserves the right to amend the Terms from time to time and such amendments will be posted to the publicly accessible section of our Web Site at MyEmergencyCrew.com.

MyEmergencyCrew does not make any representations about the content and suitability for any purpose of the information contained in the Web Site. It`s provided "as is" without express or implied warranty of any kind.

MyEmergencyCrew does not accept any liability for any damages whatsoever including any special, indirect or consequential damages resulting from loss of use, data or profits, arising out of or in connection with access to the Web Site or the use of any information contained in it.

MyEmergencyCrew does not warrant that the Web Site will be uninterrupted or free of errors.

MyEmergencyCrew does not make any warranties with regard to the Web Site or this information, including any advertisements, pricing or availability, including all implied warranties as to merchantability or fitness for use.

MyEmergencyCrew does not accept responsibility for the contents of any Web Site to which it links and the inclusion of any link does not imply any endorsement by MyEmergencyCrew of the linked Web Site.

MyEmergencyCrew reserves the right to delete any Membership Account, or related User-generated Content, for any reason without notice.

MyEmergencyCrew is made available to residents of Australia only.

Subscriptions

MyEmergencyCrew is no longer available to join. All support for Free Membership will expire on 31 December 2018 and all Free accounts will become unavailable from 1 January 2019. Current Subscriptions will remain active until their expiry days, after which no renewals will be offered.

A Subscription fee is required to maintain live, hosted Data Retention for certain Maximum Active/Operational Membership levels. These levels and the associated charges and periods are subject to change without notice. Please check the MyEmergencyCrew Subscription page for current Levels, Periods and Costs. Each Subscription applies to one (1) nominated Brigade/Unit only and cannot be shared or transferred to another. Certain Subscriptions are offered under special conditions and can only be used under those advertised conditions and availability period.

Membership Top-Up is only available to Brigades/Units with a current paid Annual Subscription Level. Membership Top-Up is not available to Brigades/Units operating a Free Account with a Maximum of 20 Members or Brigades/Units on a Monthly Subscription. Brigades/Units wishing to add more Members than the Free Account permits must purchase a Subscription. The Member Limit Top-Up will last for as long as your Primary Subscription. You should then consider a higher Subscription when renewing.

Subscriptions will become effective from the date payment is received, or at the current Subscription expiry date, whichever is later, and remain in effect until the end date.

Subscriptions may be terminated before their end date by deactivating your Account, or if any of our Terms are in breach. Subscription payments are strictly nonrefundable and nontransferable. It is your responsibility to also manage any recurring payments you may have authorised via PayPal. Any receipt of payment whilst your Account is suspended will result in a nonrefundable, automatic reactivation for the requested period and membership level.

Subscriptions are solely for the maintenance of live, hosted Data Retention for your Active/Operational Member Accounts and not required for access to any particular feature or function of MyEmergencyCrew, except where explicitly stated.

Donations made to MyEmergencyCrew or Subscriptions to the Web Site do not imply any privileged rights over the system, ownership of any functionality, commercial arrangement, or extended guarantees beyond the standard Terms of Use.

Lapsed Subscriptions will enter a 7 day grace period, after which, all non-Administrator Member Accounts will be deactivated. Administraotrs will have to reactivate individual Member Accounts, up to the subscribed limit, which for unsubscribed (free) Accounts is 20 Active/Operational Members. All retained data beyond the limits of the Free Account, will be lost.

Data Retention Policy

For Free usage by Brigades or Units with up to 20 Member Accounts, the Maximum Data Retention is 30 days. For Paid Subscriptions the Data Retention is for the duration of the current Subscription, up to a maximum 1 year for any single record from its respective Expiry Date.

MyEmergencyCrew holds expiring data for a limited time period. Any data that can be defined by an End Date, such as Events, will be purged once the Data Retention Period has expired past the defined End Date.

All Member Schedule entries, Incidents, Votes, History, Check-Ins and Geo-related data will be retained until the Data Retrntion Period has expired beyond their initial creation dates. After which they will be purged. Any History entry bound to an already purged entity, such as an Incident or Event, will be purged with the entity. All opted-in Active GPS Location Logging data is purged 24 hours after it has been captured.

Any Data, inlcuding linked records that are manually deleted by a User will not be retained beyond the time of deletion.

Brigades/Units wishing to keep their data beyond the extent of this Retention Policy may use the provided reporting and export tools.

Google Maps

Some optional features within MyEmergencyCrew make use of Google Maps to visually represent location-specific data managed by your Brigade, Unit or Group.. By using these Services you are bound my Google's Terms of Service (https://www.google.com/policies/terms/) and Privacy Policy (https://www.google.com/policies/privacy/).

If you allow your location to be passed to MyEmergencyCrew on your Device, some mapping features will in turn display that location via Google Maps whilst displayed within the web page. Your location data is used to display a location point on your device. MyEmergencyCrew may also display the location of other know Assets or Check-In Locations, for your Brigade, Unit or Group, via the Google Maps API on your device. These locations are not passed to Google or any other 3rd party provider.

Mapping information in MyEmergencyCrew is provided for visual reference only and should not be used in situations where it could lead to death, personal injury, or environmental damage.

If you opt to monitor the location of Assets visually via Google Maps, you agree that this is only for the private interests of your own Brigade/Unit and not for any Commercial or Fleet Management purposes.

Use of Data

Data may not be scraped or otherwise obtained from thie Web Site except via the published Reports, Exports and API Feeds. This Data is not intended for re-broadcast or embedding within any service that may be accessible to the general public, or to anyone outside of your direct Brigade/Unit Membership. Any breach of this condition will result in immediate Account Termination. By connecting to any of the published API feeds you agree to all terms of service.

Acceptance of Terms

This Web Site and associated Services are licensed for use by the Licensed Entity named on an accepted Application Form. This Licensed Entity is your Brigade or Unit and it's Membership. This Service is not sold and Users of the Service have no claim of ownership over any functionality or data.

You accept that activating any hyperlink within the Web Site is entirely at your own risk. MyEmergencyCrew does not guarantee any data stored on the Web Site.

Accepting this "Risk" means that you take responsibility for your actions whilst using this Web Site. It means that you are responsible for knowing the consequences of your actions and cannot hold MyEmergencyCrew accountable should you misuse this Web Site.

All of the Web Site content is protected by International and Australian Copyright, and Intellectual Property treaties. All rights are reserved. You may not copy, reverse engineer, decompile, or disassemble the software used by this Web Site, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.

You must not use the Web Site or any of the material contained in it for any purpose which is unlawful, prohibited under these Terms, or which violates any of MyEmergencyCrew's rights or the rights of any other owner of any rights in the material contained in the Web Site.

You may not use any data, descriptive text, references to functionality or intellectual property contained within this Web Site for any republication or supplementary purpose outside of the Licensed Entity. A Licensed Entity is the Brigade or Unit filed on your Application. This restriction includes any data found in HTML, Java script, exported files, or available via published or private APIs. Any instance of such republication will result in immediate Account Termination for the Licensed Entity.

Any functionality, data or intellectual property references made outside of direct system usage must be contain the proper acknowledgement of original ownership.

This agreement, between MyEmergencyCrew and you, along with your access to the Web Site is governed by the laws of New South Wales, Australia.

Membership Policy and Joining

Application for Membership is only accepted from Australian Brigade or Unit Executive, with the explicit approval of Captain (or equivalent). This mean that your Rank or Office must carry the Authority of your Captain in matters of Brigade/Unit Management and that of your Membership. Brigade or Unit activation is performed upon this approval being received in writing and is at the sole discretion of MyEmergencyCrew. Each new Brigade or Unit activation is provided with one (1) Administrative Member account only, being in the Name of the Applicant or one nominated by the Applicant. The nominated Administrator must be a current and active Member of the Brigade/Unit and have the full authority to represent and manage all Members of the same Brigade/Unit.

Applications for the establishment of a Brigade or Unit Group is accepted only from the respective Group Captain (or equivalent), and only permitted once all Brigades or Units belonging to the Group have also been established. For a Brigade or Unit to join a new or existing Group the explicit consent of that Brigade or Unit's Captain (or equivalent) is required in writing.

Application for initial Membership and the creation of a Brigade or Unit must include full details, including:

  • The Brigade or Unit's Legal Name
  • The Region or State where the Brigade/Unit operates
  • The Agency to which the Brigade/Unit is a Member of (RFS,CFS,BFS,SES, etc)
  • The Group to which it belongs (if any)
  • Any ID number within the Agency, e.g. Your Brigade's Fire Zone Number

The applicant must provide their own details including:

  • Full Name
  • Rank
  • Personal Phone Number
  • Email Address
  • Agency ID Number such as Fire Zone Number (if available)

Complete the On-Line Application Form

Member accounts can only be established and accessed using the Member's Personal Phone Number as their ID. Accounts that have been created using an invalid Phone Number will be removed from the system without notice. Two or more Members cannot share the same Phone Number as their Account ID. It is a security requirement that this policy be enforced.

PIN Security

Member Accounts must have a PIN set by the Member in order to access any functionality granted to them under their Account. This includes any elevated Administrative or Manager Rights within their respective Brigade, Unit or Group. Should a Member's PIN be reset, they will lose all allocated functions until such time as they set a new PIN via their Member Profile.

Membership Termination

Brigades and Units with lapsed Paid Subscriptions of longer than 60 days will be deactivated. Any Brigade or Unit without a current Paid Subscription where no Member activity has been logged within the previous 180 days will be deactivated.

Membership Deactivation

Any Member Account with an associated PIN will be subject to our Lock-Down Deactivation Policy. Three (3) consecutive incorrect login attempts will force the Account into Lock-Down for a period of sixty (60) minutes. During this time the Account cannot be accessed, even with the correct credentials. Any attempt to access the Account, even with the correct credentials will trigger an extension of the Lock-Down period for a further sixty (60) minutes. All login attempts will record the originating IP address from which the attempt was made.

During Account Lock-Down, auto services such as Auto-Respond and Auto-Check In will continue to operate.

Account Lock-Down can be removed by an Administrator within your Brigade or Unit. A PIN reset is required to remove the Lock-Down and release the Account so that it may be accessed again without a PIN.

Subscription

Our Paid Subscription Options allow for Brigades and Units to manage higher numbers of Member Accounts. Paid Subscriptions begin on 1 August 2017. Subscriptions are managed via PayPal and will automatically roll over unless cancelled. Any Subscription that is not renewed by it's end date will enter a 7 day grace period, after which all Administration features will become unavailable.

Support

Support Services are available only to Administrators of Brigades/Units with a current Paid Subscription. Support Services do not cover general IT requirements in Hardware or Operating System setup of configuration.

Privacy Policy

MyEmergencyCrew respects your privacy, and we have prepared this Privacy Policy in order to demonstrate our commitment to that principle and to ensure our compliance with the Privacy Act 1988 ("the Act"). MyEmergencyCrew reserves the right to amend our Privacy Policy from time to time and such amendments will be posted to the publicly accessible section of our Web Site at MyEmergencyCrew.com.

What is sensitive information?

Sensitive information concerns your racial or ethnic origin, political opinions, political associations, religious beliefs, sexual preferences, criminal record and health. Unless you have consented, MyEmergencyCrew does not collect, use or disclose your sensitive information.

MyEmergencyCrew does not collect, use or store Commonwealth identifiers. A Commonwealth identifier is a government designated identification number such as your Tax File Number or Medicare number.

What is personal information?

Personal information is any information about you that identifies you or information by which your identity can be reasonably determined.

How does MyEmergencyCrew collect your personal information?

MyEmergencyCrew collects your personal information as provided by you when you register on our Web Site, or when added by your Brigade or Unit Administrator. This may include information including your name, your email address, your internet address, your phone number(s), your fine GPS location, and any Social Media profile information you authorise to be shared with us.

This personal information is obtained when you provide it to us, in order to allow us to provide that service or information to you, and to allow you to access certain secure data which relates to MyEmergencyCrew services.

MyEmergencyCrew may also collect certain information automatically, such as the number of visits to our Web Site, the general Location of your Internet Connection, and any other details that may have been collected by our Site Survey provider (Google).

Why does MyEmergencyCrew collect your personal information?

MyEmergencyCrew collects your personal information to provide you with a specific service or specific information, and to ensure that only those entitled to access that service or information are allowed to do so.

How does MyEmergencyCrew use your personal information?

MyEmergencyCrew uses your personal information to validate your right to access areas of its Web Site which are permitted as a known visitor.

MyEmergencyCrew may use the information provided by you to promote our products or services which we consider may be of interest to you, or to notify you of important information regarding the products and services MyEmergencyCrew provides. If you do not wish us to contact you in this way, you can elect not to receive such information by editing your User Profile and removing your email address.

How does MyEmergencyCrew protect your information?

Unless required by a valid and legal request with which MyEmergencyCrew must comply, or unless you have consented, MyEmergencyCrew will not sell, rent, trade or otherwise supply to third parties any personal information obtained from you.

How does MyEmergencyCrew maintain your personal information?

MyEmergencyCrew may choose to host its own Web Site or to outsource the hosting of its Web Site to a third party internet service provider. MyEmergencyCrew will keep your personal information accurate and current and will destroy or remove your personal information when it`s no longer needed or when you de-register yourself.

How does MyEmergencyCrew keep your personal information secure?

MyEmergencyCrew has technical controls in place as well as confidentiality agreements with employees to ensure that your personal information is only accessed by those authorised to do so. MyEmergencyCrew does not store, or have access to your optional PIN.

Members with Administrative or Manager-level access are granted the ability to view, edit, delete and export personal details of their Brigade or Unit's own Members. Any action taken by Members with such elevated privileges is performed at their own discretion. MyEmergencyCrew takes no responsibility for their actions with respect to Personal Information.

3rd Party Advertising Content?

MyEmergencyCrew and third-party vendors, including Google, use first-party cookies (such as the Google Analytics cookie) and third-party cookies (such as the DoubleClick cookie) together to inform, optimize, and serve ads based on your past visits to this website. You consent to our cookies if you continue to use our website.
